TRANSFORMASI PELAYANAN KEAGAMAAN DALAM HUKUM ISLAM; ANALISIS TERHADAP EDUKASI PERKAWINAN, MEDIASI KONFLIK, DAN PELAYANAN NIKAH

The practice of Islamic family law in contemporary Muslim society demonstrates an ongoing tension between classical fiqh norms, positive legal regulations, and evolving social realities. This condition highlights the need for an approach to Islamic law that is not solely oriented toward normative legal provisions but also considers the objectives of Islamic law (maqāṣid al-sharī‘ah) and the socio-cultural context in which the law is implemented. Among the issues receiving significant attention are marriage registration, family mediation, and underage marriage dispensation, which involve not only religious normative aspects but also social, legal, and family rights protection dimensions. This study aims to analyze the practices of marriage registration, family mediation, and underage marriage dispensation at the Prenduan Office of Religious Affairs (KUA) to assess the extent to which the implementation of Islamic family law reflects the principles of public welfare (maqāṣid al-sharī‘ah), legal certainty, and the protection of family rights. This study employed a qualitative field research approach. The research data were collected through in-depth interviews, direct observation, and documentation conducted at the Prenduan Office of Religious Affairs (KUA). Data were analyzed using a descriptive-analytical method by integrating the perspectives of Islamic legal hermeneutics, maqāṣid al-sharī‘ah, and a normative approach to understand the practices of marriage registration, family mediation, and underage marriage dispensation within the socio-cultural context of contemporary Muslim society. The findings reveal that the practice of Islamic family law in contemporary Muslim communities cannot be separated from the interaction between state regulations, the socio-cultural traditions of the pesantren community, and local religious interpretations. Marriage registration is understood not merely as an administrative requirement but also as a legal instrument to ensure legal certainty and protect family rights. Furthermore, family mediation serves a strategic role in resolving domestic conflicts through reconciliation (iṣlāḥ), while the implementation of underage marriage dispensation reflects an effort to balance legal certainty with the realization of public welfare in accordance with the objectives of Islamic law. These findings indicate that the implementation of Islamic family law at the Prenduan Office of Religious Affairs has increasingly shifted from a purely normative orientation toward a more contextual and maqāṣid-based approach in responding to the needs of contemporary Muslim society.
